Marital Settlement

Marital Settlement

A marital settlement is an agreement that states the terms of the divorce, as well as the relationship between the two spouses after the divorce. Outlined in the final divorce decree, this agreement usually covers division of property, child custody, spousal support, child support, and other issues relevant to the divorce.

When it comes to working out a marital settlement, otherwise amicable divorces can quickly turn heated and resentful. Having an experienced attorney on your side can be crucial to achieving a successful resolution.

Our Phoenix divorce attorneys at Goldman Law, LLC are experienced at helping divorcing couples arrive at a favorable marital settlement at the soonest possible time in order to minimize the costs of divorce and allow both parties to move forward with their future.

Terms of a Marital Settlement

All marital settlements differ from one another, as they are based on a couples’ specific financial circumstances. Generally, however, issues usually discussed and resolved in detail in such divorce agreements include:

  • How marital assets are to be divided between parties
  • How marital debts are to be divided between parties
  • Whether or not one party will pay for the spousal maintenance payments of the other party
  • Child support payments, parenting time, and any other custody-related issues

Marital Settlement Modifications

Even if a final divorce decree has already been issued, it may still be possible for one party to request for modifications to be made to the marital settlement. However, immediate action is taken as an individual is typically only given 30 days from the date the final divorce decree was issued to file an appeal to the marital settlement.

In order to make modifications to the marital settlement, there must also exist valid grounds to request for such appeal. A party must be able to prove that there was a mistake or abuse of power on the part of the judge, or establish that some form of misrepresentation or fraud was involved in the case.

Individuals must realize that making marital settlement modifications can be a costly and time-consuming process. It is best to consult with an experienced attorney as there may be better alternatives for resolving the issues at hand.
